3. User Accounts

5. Intellectual Property

All content, features, and functionality in LinguaMirror services (including but not limited to all information, software, text, displays, images, video, and audio) are our exclusive property and are protected by copyright, trademark, and other intellectual property laws.

6. User Content

Regarding content you create while using the service:

You retain ownership of content you create
You grant us a license to use this content to provide services
You are fully responsible for your content

7. Paid Services

If you purchase paid services:

Prices may change with 30 days advance notice, but won't affect existing subscriptions during their current term
Fees will be charged according to your chosen billing cycle. We will notify you 3-7 days before auto-renewal
Refunds are available for: (a) service outages exceeding 24 hours, (b) major functionality failures, (c) erroneous charges. Refunds will be prorated based on unused service time
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you'll retain access until then

8. Disclaimer

While we strive to provide reliable service, the service is provided "as is" without warranties beyond those explicitly stated. We commit to reasonable commercial efforts to maintain service availability (target 99% uptime) and security. However, we cannot guarantee uninterrupted or error-free operation due to factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law: (1) We shall not be liable for any indirect, incidental, special, consequential, or punitive damages; (2) For direct damages, our liability is limited to the amount you paid for the service in the past 12 months; (3) These limitations do not apply to: damages caused by our gross negligence or willful misconduct, data breaches due to our negligence, or any liability that cannot be limited or excluded by law.

10. Indemnification

You agree to indemnify LinguaMirror from third-party claims arising from: (a) your violation of these terms, (b) your unlawful use of the service, (c) content you upload that infringes third-party rights. This indemnification is limited to reasonable legal fees and court-determined damages, and does not apply to claims arising from our negligence.

11. Term Modifications

We may modify these terms with 30 days advance notice for material changes. Notice will be provided via email and in-service notification. If you disagree with the changes, you may cancel your subscription before they take effect. Upon cancellation, your subscription will terminate at the end of the current billing cycle. Continued use of the service after the effective date constitutes acceptance of the new terms.

12. Service Limitations and Termination

Service Limitations: When your account balance is insufficient or quota is exhausted, paid features will be automatically suspended until you recharge or purchase a new plan. Account Termination: We reserve the right to immediately terminate your account without prior notice in the following circumstances: (a) serious violation of terms of service, (b) engaging in illegal activities, (c) fraud or identity theft, (d) posing a threat to service security, (e) legal or regulatory requirements. Upon termination, you will immediately lose access to the service and your data, and we have no obligation to preserve or export your data. We reserve the right to pursue legal action and seek damages.

13. Governing Law

These terms are governed by the laws of California, United States, excluding conflict of law rules. For consumers residing in other jurisdictions, mandatory local consumer protection laws apply where they provide greater protection. Disputes will be resolved in your local courts if required by your local law.
